A status hearing is scheduled for this week for an Aledo man seeking post-conviction relief in a gang rape case. Ryan Bell, 20, wants a new trial and will return to Mercer County Circuit Court on Tuesday, the day after his 21st birthday. He claims that some audio and video tapes of witnesses involved in the case were never turned over to his previous defense counsel. Bell pleaded guilty to a Class felony of criminal sexual assault in October 2006 and received a 20-year prison term the following May. Court testimony indicated the victim may have been drugged. Last September, his sentence and conviction was affirmed by the Illinois Supreme Court. The decision followed a similar ruling by the 3rd District Appellate Court in Ottawa. Bell based his appeal on ineffective counsel and excessive sentencing. Four juveniles were also charged with aggravated battery and attempted criminal sexual assault in the case.
Mercer County State's Attorney Greg McHugh will oppose Bell's latest attempt. He said apart from victim testimony, the prosecution had four or five eyewitnesses who implicated the defendant.
